By installing or using Flourish Forms (the “App”), the Shopify store owner (“you”, “Merchant”) agrees to these Terms. These Terms are specific to Flourish Forms; other Flourish apps have their own terms.
1. The service
The App lets you build forms, embed them on your storefront, collect and view submissions, receive email notifications, and optionally generate forms with AI. Features vary by plan.
2. Plans, billing & trials
- Paid plans are billed through Shopify’s Billing API and appear on your Shopify invoice. By subscribing you authorise Shopify to charge you.
- Plan limits (e.g. forms, monthly submissions, AI credits) are shown in-app.
- We may change pricing with reasonable notice; changes apply to the next cycle.
- Except where required by law, charges already billed are non-refundable.
3. Acceptable use
You will not use the App to: collect data unlawfully or without required consent; send spam; upload malware or unlawful content; infringe others’ rights; probe, overload, or attempt to breach the service; or resell it without permission. You are responsible for the forms you build and the data you collect through them.
4. Your data
You retain ownership of your form definitions and submissions. You grant us the limited licence needed to host and process them to provide the service, per our Privacy Policy. You are the controller of shopper personal data; we are a processor.
5. Availability
We aim for high availability but provide the App “as is” and “as available.” We may perform maintenance and may modify or discontinue features. The App is designed so that an outage affects only the form block — not your store’s checkout or theme.
6. Third parties
The App runs on Shopify and uses sub-processors (see the Privacy Policy). Your use of Shopify is governed by Shopify’s terms. We are not responsible for Shopify’s or other third parties’ acts or availability.
7. Intellectual property
The App, its code, and branding are owned by Flourish. These Terms grant you a non-exclusive, non-transferable right to use the App while subscribed.
8. Disclaimers & liability
To the maximum extent permitted by law, the App is provided without warranties. Flourish is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid us in the 3 months before the claim.
9. Termination
You may uninstall at any time. We may suspend or terminate for breach of these Terms or for security/legal reasons. On termination, your data is deleted per the Privacy Policy.
10. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-laws rules, and the courts of India shall have jurisdiction, unless mandatory local law provides otherwise.
11. Changes
We may update these Terms; material changes will be posted on this page with a new effective date. Continued use constitutes acceptance.
